Most workers in Australia—employees, contractors, subcontractors, outworkers, apprentices and trainees, work experience students, volunteers and employers who perform work. It also provides protection for the general public so their health and safety is not placed at risk by work activities.
The Regulation specifies the way in which a duty under the Act must be performed and specify procedural or administrative activities to support the Act (e.g. requiring licences for specific activities and the keeping of records).
The Codes provide practical guidance on how to meet the standards set out in the Act and the Regulation. They may be used as evidence in legal proceedings to provide guidance on what was reasonably practicable.
Recent changes to WHS legislation mandate:
Codes of Practice require complete compliance; and
If a business chooses to conduct work in a manner different to that prescribed in a Codes of Practice, they must be able to show that the standard to which they are operating meets or exceeds the relevant Codes of Practice(s).
As at 9 February 2018 there are 46 enforceable Codes of Practice in Queensland.
The Work Health and Safety and Other Legislation Amendment Act 2017 was passed by Queensland Parliament in October 2017.
In summary, the Work Health and Safety Act 2011 (Qld) (WHS Act) has been amended to:
include an Industrial Manslaughter Offence;
expand the Queensland Industrial Relations Commission's (QIRC) jurisdiction to hear and determine WHS disputes and Inspectors powers in relation to right to entry disputes;
change the obligation of employer to comply with a Codes of Practice (COP);
change the role of a Health and Safety Representative (HSR) along with employer obligations concerning training of HSRs;
establish an independent statutory office for work health and safety prosecutions; and
reintroduce the ability for a persons conducting a business or undertaking (PCBU) to appoint a Work Health and Safety Officer (WHSO).
